Work-related injuries happen all the time. It is common for employees to not get full workers compensation or any at all for several reasons. Worker’s compensation is insurance that protects employees who get hurt on the job. However, not all workers understand how the policy works. There are specific protocols involved that an employee must follow to make a claim. Failure to follow these protocols and to understand their rights has jeopardized many employees’ worker’s compensation claims. Below are some common mistakes that employees make after a work injury.

  1. Not getting a lawyer

Most insurance companies and employers have an expert legal team behind them, so why shouldn’t you get legal representation? Workers often get tricked into signing settlement deals that hurt them more than they benefit. It is a mistake to sign any document without a lawyer present.   1. Failure to report the injury immediately

This is the most common mistake by employees after incurring a work injury. According to the worker’s compensation rules, an employee is required to report an injury immediately after it happens. It does not matter how minor the injury is, let your supervisor or employer know immediately. Make the report to the employer in writing and detail. Failure to do this will lead to the employee’s integrity being questioned. Additionally, if an employee has failed to report previous injuries, it might lead to a case of fraud.   1. Failure to seek medical attention

Employees tend to disregard injuries because they seem minor. If the injury is small, then there is no need to see a doctor, right? Wrong. A doctor will give you a full report regarding the extent of the damages and the cost of treatment. This information can be used as evidence in court to help your compensation claim. It is also essential to follow the doctor’s orders regarding your recovery. Go for follow up check-ups and get the recommended medication. Also, when you visit the doctor, be sure to give a full description of your symptoms. Don’t leave anything out.

  1. Failure to retain evidence and name witnesses

Employers and insurance companies tend to fight employees when it comes to paying compensation claims. You must write down the sequence of events leading to your injury and names and numbers of those who were present. Additionally, take photos of the injury and store them safely.

If you have suffered a work-related injury, be sure not to make any of the mistakes mentioned above when making a claim. You could appeal a case if you lost. However, you will need an experienced lawyer to help determine if the case will be successful.
