How is child support calculated in Virginia?

Virginia child support is calculated using a statutory formula based on parent incomes, the number of children, custody arrangements, childcare expenses, and health insurance costs.

Virginia uses an income-shares model, meaning financial responsibility is allocated according to each parent’s income, and cost credits are given for parenting time.

Income is combined, then allocated


Most calculations follow the Virginia child support guidelines under Virginia Code § 20-108.2. Dr Andrew Lancaster, a child support researcher, says the formula used in Virginia follows the same income-shares model used across much of the United States and also in Australia.

“The core idea is that parents effectively pool part of their incomes into a combined fund, from which they draw money in proportion to the amount of care each provides,” Dr. Lancaster said.

“Fathers tend to be payers because they often have higher incomes, meaning they contribute more into the pool, while also having less custody time, meaning they draw less back out through direct care.”

How Virginia calculates child support


Virginia courts calculate child support using both parents’ gross monthly incomes, adjusted for certain existing obligations and allowable deductions. The adjusted incomes are combined and matched against the Virginia child support guidelines table based on the number of children.

The basic calculation works like this:

Parent A income + Parent B income → combined income → guideline child cost → each parent contributes based on their share of total income

For example, if Parent A earns $4,000 per month and Parent B earns $2,000, the combined monthly income is $6,000. Under the Virginia guidelines, the estimated cost of supporting one child at that income level might be about $1,000 per month.

Parent A earns about two-thirds of the combined income, so would usually be responsible for about $667 of the child cost. Parent B would be responsible for about $333. The parent with less custody time normally pays their share to the other parent as child support.

“Income shares systems try to estimate what parents would likely spend on children if the household had remained together,” Dr. Lancaster said.

How Virginia calculates the cost of children


For each case, a notional cost of children is calculated, which establishes the financial magnitude. Virginia child support guidelines calculate this amount using the parents’ combined monthly income and the number of children.

Courts use the calculated child cost as the starting point before dividing responsibility between the parents. Judges can depart from the guideline amount when the normal formula would be unfair or inappropriate.

What income counts for support


Virginia uses a broad definition of income for child support purposes. Wages, salaries, bonuses, commissions, pensions, rental income, investment income, and some government benefits may all be included in the calculation.

Certain payments are excluded from gross income. Public assistance benefits, Supplemental Security Income, and child support already being received are generally not counted. Self-employed parents may also deduct legitimate business expenses allowed under Virginia law.

Extra costs added to the formula


Virginia child support calculations often include more than the basic guideline amount. Courts may add health insurance costs, work-related childcare expenses, and some medical or dental coverage expenses connected to the child.

After additional costs are added, the total obligation is divided between the parents according to their income percentages. Online tools, such as a VA child support calculator, attempt to estimate the combined figures automatically.

Using a calculator or worksheet


A Virginia child support calculator estimates payments using the state’s income-shares formula. Most calculators follow the same process used in Virginia Courts worksheets, including Form DC-640 for shared custody cases.

Parents usually need:

  • Monthly gross income for both parents
  • Pay stubs, tax returns, or self-employment records
  • Existing spousal support or child support obligations
  • Health insurance costs for the child
  • Work-related childcare expenses
  • Number of overnight stays in shared custody cases

The calculator combines adjusted income, applies the guideline table, adds allowable child-related costs, and divides the total according to each parent’s share of income.

“Online calculators are hit or miss when it comes to accuracy,” Dr. Lancaster said. “As well, only a well-designed calculator can handle complex child support cases, such as where there are other children, multiple cases, or non-parent carers.”

How parenting time affects payments


The amount of time a child spends with each parent affects child support in Virginia.

Once a parent has the child for more than 90 days per year, the case is treated as shared custody under the Virginia formula. A 70/30 custody schedule counts as shared custody as it amounts to 2 overnights per week and just over 100 annually.

More parenting time usually lowers child support because the parent gets greater credit for out-of-pocket spending. More overnights mean you are covering more expenses like food, electricity, transport, clothing, and housing.
