Virginia Beach officer uses deadly force in domestic incident involving knife

A Virginia Beach man is dead after he allegedly charged an officer with a knife causing the officer to shoot the person who later died.

Robert Miller, 61, of Virginia Beach died at a local hospital.

According to the Virginia Beach Police Department, the fatal encounter occurred when officers responded to a call Thursday night for a drug overdose. Police arrived at the Quarter Way residence before 10:30 p.m. and located a man and woman struggling over a knife in an upstairs bedroom.

The officer reported he gave several commands to drop the knife. Instead, the male subject allegedly charged at the officer with the knife in hand.

The officer discharged his firearm in response.

“Our prayers go out to everyone affected by this tragic incident, said VB Police Chief Paul Neudigate. “We offer our comfort to the grieving family, our officer and the community during this incredibly difficult time.”.

The officer was not injured and has been placed on administrative leave which is standard practice for a critical incident such as an officer-involved shooting.

Neudigate said this was the second time in less that 48 hours where officers used deadly force.

The VBPD Detective Bureau is conducting one of two criminal investigations into this incident.

All evidence obtained by VBPD will be submitted to the Virginia Beach Office of the Commonwealth Attorney.

In addition to the VBPD investigation, the OCA conducts their own parallel, independent criminal investigation.

Upon conclusion of both criminal investigations, the VBPD internal affairs unit will conduct an administrative review to determine compliance with department policy, procedure and training.
