If a nursing home doesn’t treat your loved one the way they should be treated, you may be able to take legal action. The nursing home or facility could be responsible for negligent or reckless behavior that resulted in the harm of your family member. But is a lawsuit worth the trouble? Find out whether or not it’s worth suing the nursing home for negligence.

Is It Worth a Lawsuit?

Before trying to determine if the incident is worth the trouble of a lawsuit, you should find out if you have a strong case. Only certain behaviors qualify as negligence. If the incident did not involve a negligent or intentional act, your lawsuit will fail.

To determine if your case has a chance of success, consider the circumstances of your case. Did the nursing home fail to keep the premises safe? For instance, failing to keep the floor free of hazards makes them liable for a slip and fall accident.

Being negligent during the hiring process could also make the nursing home responsible for the incident. If they hired someone without looking into the employee’s background and that employee caused harm, the nursing home may be responsible. The same is true for an incident that occurred because the nursing home failed to train an employee.

Before you decide to file a lawsuit, consider the strength of your case. A lawyer will be able to determine whether or not you have a good chance of receiving compensation.

What’s the Outcome of a Lawsuit?

If you do have a strong case for negligence, you should consider taking legal action. Although it takes time and money to file a civil lawsuit, the effort could be well worth your energy and resources.

A successful lawsuit will result in money for your losses. This includes money for your loved one’s medical bills, pain and suffering, and other expenses.

It’s impossible to say exactly how much money you will receive for your case. However, your attorney will be able to give you an estimate of the worth of your case. Typically, the more severe the injury, the more money the victim will receive. If the incident resulted in the death of a loved one, you will also be able to recover money for the funeral expenses.

There’s another benefit to filing a lawsuit that doesn’t result in money changing hands. In addition to being compensated for your loss, you can also take comfort in knowing that the nursing home will be held accountable. You may prevent the incident from happening again.

Getting Justice for Your Loved One

With a median age of 36, Evanston has residents of varying ages. Many people are elderly and in need of special care only offered at nursing homes. Unfortunately, the facilities don’t always place their clients first.

There’s no way to take back what happened to your loved one. However, you don’t need to sit idly by as the nursing home continues to treat patients negligently. With your lawsuit, you protect your family members as well as anyone else in the nursing home.

The process of filing a claim is complex, but you don’t need to handle a claim on your own. An aggressive lawyer will take on the brunt of the work, leaving you without the burden of handling a lawsuit. With the right legal representation, you’ll get the guidance you need to have a successful lawsuit.
