Waynesboro City Council will meet Monday at 7 p.m. in the Council Chambers at the Charles T. Yancey Municipal Building, 503 W. Main St., Waynesboro.

The agenda for the meeting includes:

1. Call to Order/Pledge of Allegiance.

2. Consent Agenda (any item placed on the consent agenda shall be removed and considered as a separate matter, if so requested by any member of Council, otherwise all items will be voted on with one (1) motion).
a) Consider approving the minutes from the December 28, 2009 and January 11, 2010 Regular Business Meetings, and dispense with the reading of the minutes.
b) Consider approving a request from the Commissioner of the Revenue for a refund of $29.79 for 2009 personal property paid in error.

3. Consider adopting a proclamation naming February as Black History Month in the City of Waynesboro, and present the proclamation to Ms. Estello Randolph. 

4. Receive the Final Report of the Wayne Hills Neighborhood Stormwater Study from Don Rissmeyer of A. Morton Thomas and Associates, Consulting engineers.

5. Receive the annual report from Ms. Melissa Crocker, Chairman of the Commission of the Elderly.

6. Receive the viewer’s report and consider scheduling a public hearing for Monday, February 8, 2010 to receive citizen’s comments regarding a request from Ms. Rebecca Henkel for the City to close and vacate a 10-foot alleyway located behind a portion of Lot 1, adjacent to Lots 21 and 22, Block 47, known by street address 1105 West 12th Street, Waynesboro Land Co., in order to correct a title.

7. Receive the Planning Commission’s recommendation and consider introducing an ordinance on the request of Ms. Cynthia Wade Obenschain, owner, for a conditional use permit to allow the operation of a day care center in an existing dwelling in the RB-3 High Density Dwelling District at 405 Arch Avenue, Tax Map # 55-1-19-39, Waynesboro, Virginia.

8. Receive the Vacancy Report from the City Manager.
9. Consider introducing an appropriation ordinance to implement the Pre-emption Device Program.

10. Consider setting a public hearing for Monday, February 8, 2010 to receive public comment on amending City Code Section 22-71, Division 2 Classified Business and Occupations Tax, changing the yearly estimate-reconciliation” process for local contractors to actual gross receipts expenditures”.

11. Consider setting a public hearing for Monday, February 22, 2010 to receive public comment on amending City Code Chapter 50, Section 50.50, to modify enforcement of noise violations.

12. Consider introducing the following ordinances:
a) Appropriating the final installment of a grant from the Baseball Tomorrow Fund in the amount of $62,347 to the Special Projects Fund for renovations to the North Park Ball Field for the Fiscal Year ending June 30, 2010.
b) Appropriating a Title II Part A Grant in the amount of $3,843 to the Elementary Central Office Fund for the Fiscal Year ending June 30, 2010.
c) Appropriating a donation to the Waynesboro Library in the amount of $2,000 to the General Fund for the purchase of books and audio visual materials for the Fiscal Year ending June 30, 2010.
d) Appropriating a Title III Grant in the amount of $136 to the Elementary Central Office Fund for the Fiscal Year ending June 30, 2010.

15. Communication, Correspondence and Calendar.

16. Closed Meeting – Discussion of the award of a public contract involving the expenditure of public funds, including interviews of bidders or offerors, and discussion of the terms or scope of such contract, where discussion in an open session would adversely affect the bargaining position or negotiating strategy of the public body, as permitted by Virginia Code Section 2.2-3711(A)(29).
